GENERAL CONDITIONS OF SALE

1. OBJECT

These terms and conditions of sale are intended to define the contractual relations between HIPPOTIGRE, SAS registered in the Register of Trade and the Paris Societies under the number B878424829, and the purchaser and the conditions applicable to any purchase made through the HIPPOTIGRE merchant site, HIPPOTIGRE, whether the purchaser is professional or consumer. The acquisition of a property or service through this site implies an unreserved acceptance by the purchaser of these terms and conditions of sale.

HIPPOTIGRE reserves the right to be able to modify its terms of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the purchaser.

2.TERMINOLOGY

The services offered by HIPPOTIGRE on its website, i.e. the sale of products will be referred to as the "products", each person wishing to benefit from the products and having satisfied the general conditions set out in section 4 will be referred to as a "customer", each company that has commissioned HIPPOTIGRE to sell a product owned on its site will be referred to as a "supplier", each order made by a customer under the conditions provided.

3. CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED

The products and services offered are those contained in the catalogue published in the HIPPOTIGRE website.

The descriptions of the products offered by HIPPOTIGRE on its site are, within the limits of the information provided by the suppliers to HIPPOTIGRE, accurate. However, the information mentioned on each product sheet is given for information purposes only and the company HIPPOTIGRE cannot be held responsible if errors are introduced. Photographs do not enter into the contractual scope. The HIPPOTIGRE company undertakes to make its best efforts to correct errors or omissions as quickly as possible after having been informed of them.

All texts and images presented on the HIPPOTIGRE website are reserved for the world under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden.

4. VALIDITY DURATION OF SALES OFFERS

If you order several products, one or more of which have a delivery time indicated on the product sheet, the entire order will be shipped by default at the end of this delivery time.

In the event of ordering a product that has become unavailable, the customer will be informed of this unavailability, as soon as possible, by e-mail or telephone of the replenishment period, the delivery of a partial order or the cancellation of the order. A product substitution may be offered to the customer, often by telephone; in case of absence, an e-mail will be sent. If the flow rate has already taken place at the time of the information given on the unavailability of the product, a claim for reimbursement of the amounts incurred is made: an e-mail is then sent to the customer. Following this request, the period for which the bank account is credited is 14 days according to the law in force.

5. PRODUCT PRICES

The “Catalogue” section of our site indicates prices in euros, all taxes included, excluding shipping costs. The VAT amount and shipping costs appear on the screen at the end of the customer's selection of the different products.

The prices in the catalogue are prices included in euros taking into account the VAT applicable to the day of the order; any change in rates may be impacted on the price of products or services. HIPPOTIGRE reserves the right to modify its prices at any time, however it is understood that the price in the catalog on the day of the order will be the only applicable to the purchaser, provided that the price is serious. The prices indicated do not include the costs of processing orders, transportation and delivery as long as they occur in the geographic areas listed below.

6. ORDER

Customers have the option of ordering in two ways:

By telephone, by calling our store from Tuesday to Saturday from 10:30 a.m. to 7 p.m. on 01 42 15 53 65.
Customers guarantee that they are fully empowered to use the bank card and that this bank card gives access to sufficient funds to cover all costs resulting from the use of the products. Only legally able to subscribe contracts for the goods and services offered on the site can order on the HIPPOTIGRE site.

By clicking on the “Complete my order” button during the order process, the customer declares to fully and unreservedly accept all of these General Conditions of Sale. The data recorded by HIPPOTIGRE constitutes proof of all transactions between HIPPOTIGRE and its customers. HIPPOTIGRE will systematically confirm your order and then ship it by email.

The contractual information is presented in French and will be the subject of a confirmation including this contractual information at the latest at the time of delivery. The prices of our products are indicated including all taxes and excluding processing and shipping costs. HIPPOTIGRE reserves the right to refuse any order from a customer with whom there is a dispute.

7. MODALITIES OF PAYMENT

Payment for purchases is made by credit card. The bank cards accepted are: CB, Visa, Mastercard, American Express, Maestro and Paypal. The customer's bank account will be debited after a period of 2 days following the date of the order and this will be considered effective after confirmation of their agreement from the bank payment centers. If the bank refuses, the order will be automatically canceled.

8. DELIVERIES

The products will be sent to the delivery address that the buyer indicated during the order process, only in the agreed geographic area. Participation in processing and shipping costs is included. When shipping a complete order, HIPPOTIGRE provides an original invoice including shipping costs and VAT.

DESTINATION
HIPPOTIGRE delivers packages throughout mainland France and to European Union countries.

The risks are borne by the purchaser from the time the products have left HIPPOTIGRE premises.

Delivery rates depend on the chosen mode, the country of delivery and the weight of the order. Details can be found here.

SHIPPING TIMES
The shipping time is indicated on the site for each product. Unless specified, the products are shipped within 24 hours, when the order is placed before 8 hours. For furniture, the shipment can go up to 72 hours after the order date.

The products that include an indication of additional time (“available within 3 weeks”) are pre-orderable items, so the advertised preparation time is added to the delivery time.

Delivery times correspond to processing and delivery times, themselves calculated based on the date of receipt of the goods. These deadlines also vary depending on the destination and do not include public holidays and weekends. However, in the event of an excess exceeding 15 days, the customer will benefit from a period of 60 days from the date indicated for delivery to exercise his right of denunciation in accordance with the law of January 18, 1992. From the exercise of the right of denunciation, HIPPOTIGRE will make a refund within 14 working days.

In the event of partial delivery, this right will only concern the undelivered balance of the order.

Each delivery is deemed to have been made as soon as the product is made available to the customer by the carrier, materialized by the control system used by the carrier. It is the recipient's responsibility to check shipments upon arrival and to make any reservations and complaints that appear justified, or even to refuse the package, if it is likely to have been opened or if it bears obvious traces of damage. deterioration. Said reservations and complaints must be sent by email to the address serviceclient@hippotigre.com within three business days after delivery of the products, with a photo of the packaging, of the shipping carton with the label of the visible carrier.

If the delivered products are not in kind or in quality with respect to the specifications specified in the delivery form, the customer must, under penalty of loss, formulate their claims within three days after delivery.

In the event of a delay, breakage or missing item, the customer can contact our Customer Service via the “Contact(us)” section, on the HIPPOTIGRE website or via serviceclient@hippotigre.com.

IN THE CASE OF A COLISSIMO SUIVI:
The customer can be informed of this departure by sending an email summarizing the products sent and informing of the follow-up number allowing to click or connect to the carrier's site to know its evolution.

It then takes 2 to 3 working days to be delivered or receive a delivery notice in the mailbox. From the date the delivery notice is placed in the customer's mailbox, the customer has 15 days to collect it from the post office. If this deadline is exceeded, the package will be returned to HIPPOTIGRE. It will be up to the customer to contact HIPPOTIGRE for a possible reshipment or refund of the order (excluding shipping costs).

NON-RECEPTION OF PARCEL
If 5 working days after the shipment of the package, the customer does not have any news of his order, he can check the carrier’s site with the enumerated follow-up number and contact the Customer Service to obtain more information about the delivery status of his package.

If neither the Post Office nor the parcel tracking (www.coliposte.net) say they have trace of this package, the customer must then show up at HIPPOTIGRE via the "Contact" section.

HIPPOTIGRE Customer Service will then open an investigation with the Post Office services. The customer will then receive an email informing them that an investigation has been opened. Final response times from the Post Office vary from one to three weeks, from the sending of the email sent to the customer.

If the package is found, it is then sent to the customer: the reception procedure follows its normal course (deposit of the package or notice of passage, etc.)
If the package is declared lost (the final response is often made within the maximum time limits, or three weeks), HIPPOTIGRE then advises the customer and immediately initiates the return of the order or the refund of the package (products and shipping costs), depending on the availability of the product and the customer's decision.

 IN THE CARRIAGE CASE:

In case of bulky packages, the package is packed and delivered on pallet, at the doorstep or at the entrance of the building. The carrier and the customer make an appointment together for delivery, deciding on a delivery day. Delivery can take place throughout the day at the customer's place, between 9am and 6pm.

In case of absence, a notice of passage is filed in the mailbox: the carrier's contact details are then communicated to the customer who must then agree to an appointment by calling them the number indicated on the notice.

If the Customer did not show up at the time of appointment chosen with the carrier, the delivery will be unsuccessful. It is therefore necessary to plan a second delivery, which will be charged to the customer. In the event of an unavailability of the Customer on the date initially chosen, the Customer must notify the carrier 48 hours before the scheduled date. Without this, the appointment chosen cannot be canceled.

If the carrier cannot leave the notice of passage (unknown address, door code un communicated...), it contacts HIPPOTIGRE to have the missing element with the customer. Without response, the package returns to HIPPOTIGRE and a refund is then made.


IN-STORE PICKUP

HIPPOTIGRE offers its customers to withdraw their orders in store, at n°85 rue Jean de la Fontaine, 75016 - Paris from the time they were informed by email of the availability of their orders.

Customers have a month to come and remove the parcels from the date of sending the notification sent by mail “Set for withdrawal”.

9. AFTER-SALES SERVICE

10. LAW OF RETRACTATION

All products sold on eshop are entitled to the "satisfied or refunded" clause for 30 days from the date of delivery in accordance with the provisions of the Consumer Code, Article L 121-21, provided that the product has not suffered any damage and is in its original packaging.

In order to facilitate the processing of the refund, any return must be previously authorized by HIPPOTIGRE with the allocation of a return number and a return voucher to be inserted into the cardboard with the returned products. You must inform HIPPOTIGRE at the following email address: serviceclient@hippotigre.com or via the withdrawal form on the “my account” page.

The return will take place at the following address, unless otherwise specified: HIPPOTIGRE, Service Retours, 85 rue Jean de la Fontaine, 75016 - Paris.

The customer exercises his right of withdrawal in accordance with article L 121-21 of the Consumer Code within 30 days from receipt of the goods. This right is exercised by returning the product to HIPPOTIGRE. Reimbursement to the customer will be made by transfer within 14 days of receipt of the goods by HIPPOTIGRE, following the exercise of the right of withdrawal.

The right of withdrawal may also be exercised from the order and prior to the logistical processing of the package. In this case, the order is simply cancelled and we make the refund.

No refund return will be accepted, regardless of the reason.

This retracting faculty can never play if the products delivered have clearly been subject to sustainable use (beyond a few minutes).

The products must be returned properly protected, in their original packaging, in a perfect state of resale (not damaged, damaged or prepared by the customer) accompanied by any accessories, notices of employment and documentation to the above address, accompanied by the original sales invoice, of which the customer will keep a copy.

Also, the packages for which no attachment can identify the sender (order number, mail, name, name, address).

The costs and risks associated with the return of the product are borne by the sender.

Exception to the right of withdrawal

The exercise of the right of return is excluded for the following products or services:

- services whose execution began with your authorization

11. LEGAL GUARANTEE OF HIDDEN DEFECTS

All products supplied by the seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code. In the event of hidden defects in a product sold, it may be returned to the seller who will take it back, exchange it or reimburse it. 12. RESPONSIBILITY

The seller, in the online sales process, is only bound by an obligation of means; liability may not be incurred for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service failure, or other involuntary problems.

13. INTELLECTUAL PROPERTY

All elements of the HIPPOTIGRE site are and remain the intellectual and exclusive property of HIPPOTIGRE. No one is allowed to reproduce, exploit, rebroadcast, or use, in any way, even in part, elements of the site, whether software, visual or audio. Any simple or hyperlink is strictly forbidden without an explicit written agreement of HIPPOTIGRE.

14. PERSONAL DATA

Information collected or processed on the occasion of your navigation on the HIPPOTIGRE site is subject to computer processing for HIPPOTIGRE, its subcontractors and partners, in order to improve the services offered, process your requests, facilitate your navigation and registration and inform you of HIPPOTIGRE offers and news, except in case of opposition from you.

15. ARCHIVING

HIPPOTIGRE will archive the purchase orders and invoices on a reliable and durable support that constitutes a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. The electronic records of HIPPOTIGRE will be considered by the parties as evidence of communications, orders, payments and transactions between the parties.

16. RESPONSIBILITY – DISPUTES – APPLICABLE LAW

The photographs and texts reproduced and illustrating the products presented are not contractual. As a result, HIPPOTIGRE's liability cannot be incurred in the event of an error in any of these photographs or any of these texts.

HIPPOTIGRE cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from malfunction or misuse of the products sold. The same applies to any modifications to products resulting from suppliers.
Unprotected stone, marble or wood are materials whose maintenance must be meticulous.
Indeed, natural stone or wood have a protective finish, but still remain very fragile to moisture and fat in particular.
That's why we recommend using sub-glasses, and that any spill must be wiped out immediately.
Therefore, HIPPOTIGRE discharges any liability related to use contrary to the prescribed recommendations.

HIPPOTIGRE's liability will, in any case, be limited to the amount of the order and cannot be held liable for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products.

HIPPOTIGRE cannot be held liable, to a customer or third party, for any indirect damage, for any loss of exploitation, profit or turnover, in any way, even if such damage or loss or loss were foreseeable by HIPPOTIGRE, or if its eventuality had been brought to its attention.

Without limiting the preceding paragraphs, the liability of HIPPOTIGRE under these Terms and Conditions shall not exceed an amount equal to the amounts paid or payable during the transaction at the origin of the said liability, regardless of the cause or form of the action concerned.

HIPPOTIGRE shall not be held liable for failure to perform the contract concluded in the event of a stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, including postal services and means of transport and/or communications, flooding, fire.

In case of litigation, the client will address HIPPOTIGRE by priority to obtain a friendly solution. If not, the Paris courts are solely competent, some are the places of delivery and the payment methods accepted.

These general conditions of sale in French will be enforced and interpreted in accordance with French law. Any dispute that may arise in connection with its validity, interpretation or execution will be submitted to the Paris Tribunals, to which it is expressly assigned exclusive jurisdiction.

HIPPOTIGRE reserves the right to modify the general terms and conditions of sale. Customers who would not like contractual relations to be governed by the new version of the general terms and conditions of sale will be notified and, as of the date on which the new version will take effect, they will have to stop using HIPPOTIGRE services. In the case that any of the terms of the general terms of sale would be considered illegal or unopposable by a court decision the other provisions will remain in force.
